These terms govern your use of YourGymOS. By creating an account or using the service you agree to them. If you are agreeing on behalf of a gym or company, you confirm you are authorised to do so.

YourGymOS is a service name, not a registered company. It is not incorporated as a company, LLP or other registered entity, and it has no company registration number. The service is operated independently. If you need the operator's details for a legal or regulatory purpose, email hello@yourgymos.com and we will provide them.

The service

YourGymOS is software for managing a gym business: members, memberships, attendance and check-in, invoicing and payments, fitness programming, leads and follow-ups, member portal access, and communication including WhatsApp where you connect it.

Your account and your organization

• You are responsible for the accuracy of the information you provide and for keeping your sign-in credentials confidential.
• The person who creates an organization becomes its owner. Owners control who else is invited and what role they hold.
• You are responsible for what the people you invite do within your organization.
• You must not attempt to access another organization's data, probe or circumvent the platform's access controls, or use the service to send unlawful or unsolicited messages.

Your data

The data you enter remains yours. We process it to provide the service, as described in our privacy policy. You are responsible for having a lawful basis to record the member information you enter, and for honouring your members' rights over it.

WhatsApp and messaging

Where you connect WhatsApp, you use your own WhatsApp Business account and remain bound by Meta's terms and messaging policies in addition to these terms. You acknowledge that:

• WhatsApp permits free-form replies only within a limited window after a customer messages you; outside that window, messages must use templates approved by Meta.
• Automated reminders cannot be delivered until Meta has approved the required outbound templates for your WhatsApp Business account. Approval is granted by Meta, not by us, and we cannot guarantee it or its timing.
• Message delivery depends on the WhatsApp Business Platform. We are not responsible for delays, failures or policy decisions made by Meta.

Fees

Fees, billing period and payment terms are those agreed in writing with you. Unless agreed otherwise, fees are payable in advance and are non-refundable for a period already used. We will give you notice before any change to your fees takes effect.

Availability

We work to keep the service available and will give reasonable notice of planned maintenance where we can. We do not guarantee uninterrupted availability, and the service may depend on third-party providers whose outages are outside our control.

Suspension and termination

You may stop using the service at any time. We may suspend or terminate access where these terms are materially breached, where fees are unpaid after notice, or where continued use would put the platform or other customers at risk. On termination you may request an export of your data within a reasonable period, after which we may delete it in line with our retention practice.

Changes to the service and to these terms

The product changes as it develops. Features described as forthcoming - including AI-assisted automation - are not part of what you are contracting for today, and we make no commitment about whether or when they will become available. If we change these terms materially we will tell you before the change applies.

Liability

Nothing in these terms limits liability that cannot lawfully be limited. Subject to that, neither party is liable for indirect or consequential loss, or for loss of profit, revenue or anticipated savings; and our total liability arising out of the service is limited to the fees you paid for it in the twelve months before the claim arose.

Governing law

These terms are governed by the laws of India.
